Draconis Talents Legal and Derivative Works Policy
1. Permission to Use Draconis Talents IP
TL;DR: Making free stuff for the community in a respectful, positive way? Awesome, go ahead. Making stuff for profit or in a way that's insulting, mean, or damaging? That’s not going to be allowed.
You are granted a personal, non-exclusive, non-transferable, revocable, limited license to use, display, and create derivative works based on Draconis Talents’ intellectual property strictly for non-commercial community use, provided you follow all rules herein.
We reserve the right to revoke this license at any time, for any reason or no reason, especially if we determine your use conflicts with our values or guidelines. Upon revocation, you must immediately stop all development, publication, or distribution of your project.
2. Commercial Use Restrictions
TL;DR: Don’t put your project behind a paywall, charge people, or try to generate revenue from it unless you have a prior written license agreement or the revenue is passively earned by promoting the project in videos, streams, or other content.
No commercial or mass-produced projects (e.g., large-run merchandise, commercial products, or paywalled content) are allowed without prior written license agreement.
Small-scale fan sales (e.g., artwork, crafts at conventions) are permitted as hobby-level activity, but large volume or high-priced sales may be restricted.
Crowdfunding, paywalled platforms (Patreon, Fansly, YouTube Premium, etc.), or business-related uses require explicit permission.
Passive revenue generation via ads on streams or videos promoting your project is allowed, provided ads are appropriate and do not use untransformed official assets (e.g., monetizing simple clip compilations is prohibited).
Use of official assets without transformation or originality is not eligible for monetization.
3. Originality Requirements
TL;DR: Simply streaming your face on top of existing content isn’t enough. You must add original, creative elements to anything using Draconis Talents IP.
Be original—fans want to see your unique contributions.
Copying or lightly modifying existing content and passing it off as your own is not acceptable.
Light commentary (like subtitles or minimal reactions) won’t suffice.
You must add genuine creativity to your work.
We use content ID and other services to detect unoriginal or cannibalizing content.
4. Use of Logos, Trademarks, and Official Assets
You may not use Draconis Talents’ logos, trademarks, character names, or official branding in any project, website, advertising, domain names, or social media accounts without explicit written permission.
Use of official music, videos, images, or other assets as-is (without creative modification) is prohibited and considered counterfeit.
This helps avoid confusion between fan projects and official Draconis Talents content.
5. NSFW Content
NSFW content using Draconis Talents IP is permitted only if non-commercial and contains original creative elements.
NSFW works must be clearly marked and restricted to appropriate audiences.
Always adhere to platform-specific guidelines for NSFW content.
6. Sharing and Attribution
TL;DR: Yes! Just make sure people know it’s a fan project, not an official Draconis Talents product.
When sharing, you must include a clear disclaimer such as: "[Project Title] was created under Draconis Talents’ Legal and Derivative Works Policy using Draconis Talents assets. Draconis Talents does not endorse or sponsor this project."
7. Official Use of Fan Projects
Draconis Talents may feature or build upon fan-created projects. We will contact you for permission if we want to use your work officially.
8. Derivative Works Guidelines
Applies to all original Draconis Talents content: characters, models, art, and related IP.
Derivative works must include new, creative contributions; mere reproduction is prohibited.
Member-only or private content cannot be used without explicit permission.
Applies to individuals and non-legal entities worldwide; corporations or businesses must contact us before proceeding.
9. Conduct and Content Restrictions
Respect Draconis Talents VTubers; do not create content that offends, misrepresents, or impersonates them.
Keep activities at a fan or hobby level; avoid commercial use without license.
Do not alter official assets in unauthorized ways.
Comply with all applicable laws and platform terms.
10. Sales and Commercialization
Hobby-level sales (artwork, crafts) are permitted within reasonable scale.
High-volume or high-priced sales deemed business activity may be suspended.
Contracted artists must have separate agreements to sell official art.
Sale of 3D merchandise (figures, plushies) is restricted to authorized events; contact organizers for permissions.
11. Prohibited Content
Do not create derivative works that could be mistaken as official Draconis Talents content.
Do not create socially unacceptable content or content damaging to Draconis Talents or its talents.
Do not include political, ideological, religious, or similar themes.
Do not violate third-party rights or harm others.
Do not create content deemed inappropriate or unsuitable by Draconis Talents.
